During the Supreme Court hearing in the Petro Poroshenko case, the judge asked why representatives of the president and the government did not provide the documents on the basis of which sanctions were imposed against the fifth president. The government representatives were unable to provide an answer, shifting responsibility to other bodies, which caused the judge’s indignation.<\/strong><\/p>\n

“You represent the President of Ukraine in the court session. What did you, as a representative of the President of Ukraine, as a representative of the office, do to ensure that where the president is the head, the order was fulfilled?” the judge asked.<\/p>\n

The confusion of the OP and government representatives even caused laughter in the courtroom at one point.<\/p>\n

“Let me explain. Your Honor, a separate body has been created to ensure the activities of the National Security and Defense Council – APAAK of the National Security and Defense Council. In this case, the organizational support of the activities of the National Security and Defense Council, regardless of who heads it, is carried out by this body – APAAK of the National Security and Defense Council. Therefore, as a representative of the President, I do not have other documents and other explanations regarding the documents that are at the disposal of another body. These are other bodies that are created to ensure the activities of the National Security and Defense Council,” said the representative of the Office of the President.<\/p>\n

She also added that the president cannot interfere in the activities of the APAAK, since the APAAK of the National Security and Defense Council is subordinate to another person.<\/p>\n

“The Cabinet of Ministers of Ukraine is the highest body in the system of executive bodies. The highest! Where is Finmonitoring? In Africa? Why hasn’t the court’s ruling been implemented? And not the Secretary of the Cabinet of Ministers of Ukraine, as you keep referring to the secretary here. Why hasn’t the government implemented the court’s ruling?”, the judge wrote to the representative of the Cabinet of Ministers.<\/p>\n

To which I tried to clarify what the method of execution should have been.<\/p>\n

“All documentation related to the acts was provided. The court hearing continued, the documents were provided. There is a separate entity, it monitors,” the Cabinet representative replied.<\/p>\n

The judge emphasized that the representative of the Cabinet of Ministers is a third party in the case.<\/p>\n

“You are a third party in the case. In a case where the president filed a lawsuit, you are a third party, you are the government. The highest executive body. Everyone is under you. Why hasn’t the court’s ruling been implemented?” the judge asked the government representative. <\/p>\n
