This is a violation of the UN Charter, and it opened the door to other war crimes: the killing of civilians, deportations, torture, the shelling of peaceful cities.<\/p>\n<p> &#8220;This is an extremely important step. We are beginning the process of creating a tribunal that will become an instrument of justice for everyone who has suffered from Russian aggression. Justice takes time, but it will come,&#8221; said Volodymyr Zelenskyy.<\/p>\n<p> He added that international institutions, including the ICC, do not have the authority to prosecute Russia specifically for the crime of aggression. The new tribunal is designed to fill this legal gap.<\/p>\n<p> &#8220;There is still a long way to go politically. We have already made great progress, and I am grateful to the Committee of Ministers, grateful to the Council of Europe and everyone who has shown leadership. Justice takes time, but it must happen,&#8221; the President of Ukraine emphasized.<\/p>\n<p> Zelensky also expressed confidence that the agreement on the Special Tribunal provides real chances to condemn crimes of aggression.<\/p>\n<p> &#8220;Other institutions, even international ones, do not have the tools to do this. And we need to show clearly that aggression will be punished. And we must do this together throughout Europe. Glory to Ukraine!&#8221; \u2014 the president concluded.<\/p>\n<p> At the same time, the Council of Europe Office in Ukraine <a href=\"https:\/\/www.coe.int\/en\/web\/portal\/frequently-asked-questions\" rel=\"nofollow noopener\" target=\"_blank\">noted<\/a> that the International Criminal Court, which is already considering the crimes of the Russian Federation in Ukraine, <strong>has jurisdiction to investigate both war crimes and crimes against humanity and genocide in Ukraine<\/strong> .<\/p>\n<p> However, the court does not have full jurisdiction to prosecute the crime of aggression. This crime concerns the decision to use armed force against another state, in violation of the UN Charter. The Special Tribunal must remedy this, as it is mandated to prosecute high-ranking officials for the crime of aggression against Ukraine.<\/p>\n<p> People&#8217;s Deputy Maria Mezentseva, who participated in developing the concept of the tribunal, <a href=\"https:\/\/t.me\/mezentseva168\/17552\" rel=\"nofollow\" target=\"_blank\">explained<\/a> the key features:<\/p>\n<ul><\/p>\n<li> <strong>There is no immunity<\/strong> &#8211; even presidents and prime ministers of the Russian Federation can be held accountable.<\/li>\n<p><\/p>\n<li> <strong>Conviction in absentia<\/strong> &#8211; sentences are possible without the physical presence of the accused.<\/li>\n<p><\/p>\n<li> <strong>Without amnesties<\/strong> , no political &#8220;agreement&#8221; will stop the process.<\/li>\n<p><\/p>\n<li> <strong>The real terms<\/strong> are up to 30 years or life imprisonment.<\/li>\n<p><\/p>\n<li> <strong>Compensation to Ukraine<\/strong> &#8211; assets of criminals can be confiscated for the benefit of victims.<\/li>\n<p><\/p>\n<li> <strong>Victim and witness protection<\/strong> \u2014 a special unit will work on witness safety.<\/li>\n<p><\/p>\n<li> <strong>Gender balance<\/strong> is fairness that takes into account the rights of women and men.<\/li>\n<p><\/ul>\n<p> The creation of the tribunal is not just a political signal, it is <strong>a legal breakthrough for all of Europe<\/strong> . For the first time since the Nuremberg Trials, the international community is creating a separate court to hold the leaders of an aggressor state accountable for <strong>the decision to start a war<\/strong> .<\/p>\n<p> The special tribunal will operate in The Hague, the world capital of international justice. Its creation was supported by dozens of countries and the Council of Europe, and the mechanism itself will become <strong>a precedent for the global legal system<\/strong> : no aggressor will feel impunity anymore.<\/p>\n<p> It was previously reported that on Wednesday, June 25, a historic event will take place in Strasbourg \u2014 President of Ukraine Volodymyr Zelensky and Secretary General of the Council of Europe Alain Berset will sign an agreement on <a href=\"https:\/\/prm.ua\/istorychnyy-krok-do-spravedlyvosti-ukraina-i-rada-yevropy-pidpyshut-uhodu-pro-stvorennia-spetstrybunalu-shchodo-ahresii-rf\/\">the establishment of a Special Tribunal to investigate the crime of Russian aggression against Ukraine<\/a> . This will be Zelensky&#8217;s first official visit to the Council of Europe.<\/p>\n<p> As reported, the Secretary General of the Council of Europe, Alain Berset, stated that <a href=\"https:\/\/prm.ua\/trybunal-dlia-putina-stvoriat-v-ramkakh-rady-yevropy-vidoma-data\/\">a special tribunal on the crime of aggression will be established within the Council of Europe<\/a> . This could happen as early as 2025.
