Ukraine is forming a mechanism for submitting claims to an international registry of damages and a compensation commission to determine the total amount of damage caused by Russian aggression. The process is based on individual applications from citizens and companies that have suffered from Russia’s actions.<\/strong><\/p>\n

This was stated by<\/a> Foreign Ministry representative Mykola Yurlov during a roundtable at UNIAN on the use of seized Russian assets.<\/p>\n

“These are not only citizens of Ukraine, these are individuals of any nationality, legal entities, including foreign ones, on the territory of Ukraine. And the state of Ukraine can file claims or applications to the international register of damages, and later – to the international compensation commission. We strongly urge those who have suffered from Russian aggression to file such applications or claims to the register of damages. And then we will be able to universalize the total amount of claims against the Russian Federation for damage caused as a result of the aggression,” Yurlov explained.<\/p>\n

According to the diplomat, thanks to these statements, Ukraine will be able to create a single basis for further reparations demands and use it in international courts and structures that are already working on a compensation mechanism.<\/p>\n

At the same time, Anna Vlasyuk, an expert at the Kyiv School of Economics, emphasized that Russia has no legal grounds to file counterclaims regarding the arrest or confiscation of its assets in Europe.<\/p>\n

“The answer is no. And it is very simply explained, because there is no international treaty that would establish the jurisdiction of an international court over Russia in relation to this nature of a dispute,” she said.<\/p>\n

Vlasyuk added that the International Court of Justice carefully evaluates each case, and even if there are relevant treaties, it can refuse to consider it if the issue does not fall under their provisions. That is why, according to her, Russia does not have “any treaty that would even approximately give it the right to sue the International Court of Justice.”<\/p>\n

It should be noted that the European Commission has developed a new initiative that involves using the proceeds from frozen Russian assets to finance a large-scale loan to Ukraine.<\/a> This is an amount of 140 billion euros, which Kyiv will be able to receive to support the budget and strengthen the defense sector.<\/p>\n

As a reminder, the European Commission has come up with a new way to transfer billions of euros in frozen Russian assets to Ukraine<\/a> . In particular, Europe is proposing to replace the money with EU-backed debt obligations.<\/p>\n
