{"id":1317742,"date":"2025-11-08T13:55:07","date_gmt":"2025-11-08T11:55:07","guid":{"rendered":"https:\/\/prm.ua\/they-were-preventive-now-they-are-educational\/"},"modified":"2025-11-08T13:55:07","modified_gmt":"2025-11-08T11:55:07","slug":"they-were-preventive-now-they-are-educational","status":"publish","type":"post","link":"https:\/\/prm.ua\/en\/they-were-preventive-now-they-are-educational\/","title":{"rendered":"They were &#8220;preventive&#8221; &#8211; now they are &#8220;educational&#8221;"},"content":{"rendered":"<p><em>Source: Author&#8217;s <a href=\"https:\/\/www.facebook.com\/sofiya.fedyna\/posts\/pfbid02Fc3FF6wZyspvjxRmHZy73uW9895jUbEQHEGzkNqP9F8s9x2KkSfeJzmr2STwX5egl\" target=\"_blank\" rel=\"noopener nofollow\">Facebook<\/a> page<\/em><\/p>\n<p> <strong>During a closed meeting, Zelensky&#8217;s representatives managed to reveal a new pearl: the sanctions against Poroshenko now also have an &#8220;educational nature.&#8221;<\/strong><\/p>\n<p> Lawyer Ilya Novikov said during a break in the hearing: &#8220;We heard with our own ears that a person who has been sanctioned in the form of deprivation of state awards should think about his behavior.&#8221;<\/p>\n<p> And unfortunately, the general public does not see this &#8211; despite the fact that there are no secret materials left in the case.<\/p>\n<p> Even MPs who have access to documents with the &#8220;DSK&#8221; stamp were not allowed to attend the meeting.<\/p>\n<p> <strong>What are the sanctions for?<\/strong><\/p>\n<p> They didn&#8217;t say anything &#8211; they already fell for the first point, about the deprivation of state awards.<\/p>\n<p> &#8220;It turned out that the President of Ukraine does not know exactly which state awards he deprived Poroshenko of,&#8221; Novikov noted.<\/p>\n\t\t<aside class=\"shortcode-also\" data-title=\"Read also\" >\n\t\t<a href=\"https:\/\/prm.ua\/en\/militant-ignorance-the-authorities-have-set-up-a-russian-style-courtroom\/\">Militant ignorance: the authorities have set up a Russian-style courtroom<\/a>\n\t<\/aside>\n\n<p> <strong>The issue of falsified evidence.<\/strong><\/p>\n<p> The disk with attachments, which was allegedly handed over on February 12 for consideration at the meeting, actually contains files created on February 13, that is, after the meeting.<\/p>\n<p> Moreover, Prime Minister Shmyhal&#8217;s cover letter was registered at 11:13 p.m. on the same day.<\/p>\n<p> This indicates that the documents could have been issued retrospectively.<\/p>\n<p> No explanations were given in court on this matter, and the court has so far refrained from making an assessment, but noted that this issue will not disappear from the case.<\/p>\n<p> <strong>Context of the ECHR.<\/strong><\/p>\n<p> Since the last meeting (October 13), a decision of the European Court of Human Rights has appeared, which actually overturns the entire practice of Ukraine&#8217;s sanctions policy from the very beginning.<\/p>\n<p> The ECHR disagrees, including with the Supreme Court of Ukraine, on what constitutes an interference with human rights when it comes to sanctions.<\/p>\n\t\t<aside class=\"shortcode-also\" data-title=\"Read also\" data-right>\n\t\t<a href=\"https:\/\/prm.ua\/en\/the-black-and-white-world-of-political-intrigue-psychosis-is-growing-on-bankova-street\/\">The black and white world of political intrigue: psychosis is growing on Bankova Street<\/a>\n\t<\/aside>\n\n<p> &#8220;And now it turns out that almost the entire doctrine of what the president&#8217;s power is when it comes to sanctions &#8211; where the limits of that power are and where it ends &#8211; could very quickly go into the trash.<\/p>\n<p> Because the European Court has the final say in these matters: if it says that this cannot be done, it means that this cannot be done,&#8221; the lawyer emphasized.<\/p>\n<p> We haven&#8217;t reached this issue yet, but it will be considered.<\/p>\n<p> <em>We will remind, on the eve of the panel of judges of the Cassation Administrative Court within the Supreme Court, which is considering Petro Poroshenko&#8217;s lawsuit to cancel the Decree on sanctions, completed the consideration of documents with the DSK stamp (for official use), on the basis of which the NSDC decision was made.
