We are told that if Donald Trump accepts Russian demands \u2014 even in a version edited by Washington \u2014 Ukraine will be offered security guarantees \u201csimilar to Article Five of the Washington Treaty.\u201d<\/strong><\/p>\n

It must be stated with full responsibility that Article Five of the Washington Treaty \u2014 more precisely, the North Atlantic Treaty \u2014 like any other provision of this international agreement, applies exclusively within the framework of the treaty as a whole. In practical terms, it operates only in the context of full NATO membership<\/strong>.<\/p>\n

For the same reason, Ukraine cannot rely on Article 42(7) of the Treaty on European Union, which obliges EU Member States to provide aid and assistance by all means in their power in the event of an armed attack on a Member State, in accordance with Article 51 of the UN Charter \u2014 at least until Ukraine becomes a member of the European Union.<\/p>\n

Any analogous clause in bilateral agreements could be effective only if the U.S. Congress were to sign and ratify a Treaty of Alliance between Ukraine and the United States<\/strong> \u2014 one that explicitly provides for U.S. involvement in a war against an aggressor in the event of a threat to Ukraine\u2019s territorial integrity and sovereignty. Ukraine, in turn, would have to be prepared to assume reciprocal obligations.<\/p>\n\t\t
