Zelenskyy\u2019s representative did not appear \u2014 she \u201cfell ill.\u201d Moreover, there is a nuance. And not just one. After all, this is an administrative process.<\/p>\n<p data-start=\"482\" data-end=\"649\">First, it wasn\u2019t merely the \u201crepresentative\u201d who failed to show up. In fact, Zelenskyy himself did not appear, because there is a principle of \u201cself-representation.\u201d<\/p>\n<p data-start=\"651\" data-end=\"970\">The party in question is the President as an institution, and therefore, there should have been a representative. For the State Administration of Affairs, whose employees are paid from the Presidential Office budget \u2014 which this year provides 5.25 billion UAH, and last year 4.2 billion \u2014 this is not a trivial matter.<\/p>\n<p data-start=\"972\" data-end=\"1124\">So it was not a case of \u201cthey couldn\u2019t find anyone to send.\u201d It was a conscious decision not to appear. Why? Here, guilt is not established as in criminal cases, nor are competing \u201ctruths\u201d weighed as in civil litigation. In an administrative case, a state body must\u00a0justify the legality of its actions to the person asserting that their rights have been violated. Failure to appear in court is effectively an admission that there are no arguments to support the state\u2019s position.<\/p>\n<p data-start=\"583\" data-end=\"1052\">Finally, thirdly, after the ECHR decision in a recent sanctions case, a precedent has effectively been set: the President <em data-start=\"705\" data-end=\"711\">must<\/em> justify his sanction decisions. In the case, <em data-start=\"756\" data-end=\"775\">M.S.L. v. In Ukraine<\/em>, the European Court of Human Rights found that the lack of effective judicial review of Ukrainian sanctions violated the Convention, highlighting that national courts must provide meaningful oversight and justification in sanctions cases. <span class=\"\" data-state=\"closed\"><span class=\"ms-1 inline-flex max-w-full items-center relative top-[-0.094rem] animate-[show_150ms_ease-in]\" data-testid=\"webpage-citation-pill\"><a class=\"flex h-4.5 overflow-hidden rounded-xl px-2 text-[9px] font-medium transition-colors duration-150 ease-in-out text-token-text-secondary! bg-[#F4F4F4]! dark:bg-[#303030]!\" href=\"https:\/\/interfax.com.ua\/news\/general\/1113382.html?utm_source=chatgpt.com\" target=\"_blank\" rel=\"noopener nofollow\"><span class=\"relative start-0 bottom-0 flex h-full w-full items-center\"><span class=\"flex h-4 w-full items-center justify-between\"><span class=\"max-w-[15ch] grow truncate overflow-hidden text-center\">\u0406\u043d\u0442\u0435\u0440\u0444\u0430\u043a\u0441-\u0423\u043a\u0440\u0430\u0457\u043d\u0430<\/span><span class=\"-me-1 flex h-full items-center rounded-full px-1 text-[#8F8F8F]\">+1<\/span><\/span><\/span><\/a><\/span><\/span><\/p>\n<p data-start=\"1054\" data-end=\"1445\">The notion of \u201cdiscretion\u201d that the authorities tried to invoke does not hold up. Discretion is not arbitrariness, but the ability to choose between different lawful options. There is no legal basis for imposing sanctions on an individual Ukrainian citizen who is not a terrorist. Yet, faced with high\u2011profile personnel decisions, Zelenskyy wrapped himself in a \u201cchequered blanket\u201d in court.<\/p>\n<p data-start=\"1447\" data-end=\"1671\">He is buying time until the end of the month \u2014 likely to strengthen his \u201cvertical\u201d and put pressure on the judiciary so that, when elections come, they will unfold on his terms rather than through an open democratic process.<\/p>\n<p data-start=\"1673\" data-end=\"1754\">But attempts to turn Ukraine into Russia, Belarus, or Venezuela will not succeed.<\/p>\n<p data-start=\"1756\" data-end=\"1906\">If Zelenskyy has not learned this over nearly seven years in office, life itself will teach him \u2014 and not even a chequered blanket will save him then.<\/p>\n\t\t<aside class=\"shortcode-also\" data-title=\"Read also\" data-right>\n\t\t<a href=\"https:\/\/prm.ua\/en\/lawyer-novikov-poroshenko-is-the-only-person-against-whom-there-are-sanctions-from-both-putin-and-zelensky\/\">Lawyer Novikov: Poroshenko is the only person against whom there are sanctions from both Putin and Zelensky<\/a>\n\t<\/aside>\n\n<p><em>We will remind you that the day before, the representative of President Volodymyr Zelenskyy <a href=\"https:\/\/prm.ua\/vlada-shtuchno-zatiahuie-protses-predstavnytsia-prezydenta-ne-pryyshla-u-verkhovnyy-sud-iakyy-maie-ukhvalyty-rishennia-shchodo-nezakonnykh-sanktsiy-proty-poroshenka\/\">did not appear at the meeting<\/a> of the Board of Judges of the Cassation Administrative Court of the Supreme Court, where the consideration of Petro Poroshenko&#8217;s lawsuit to cancel the illegal Decree on the introduction of sanctions continues.<\/em><\/p>\n<p><em>Earlier, it emerged during the case proceedings that some of the documents justifying the imposed sanctions <a href=\"https:\/\/prm.ua\/materialy-na-pidstavi-iakykh-zaprovadyly-nezakonni-sanktsii-proty-poroshenka-vnosyly-zadnim-chyslom-advokat\/\">had been submitted to the NSDC retroactively<\/a>. The decision was made, and the Decree was signed. At previous sessions of the Supreme Court, in particular, evidence of falsification of the decision on sanctions against Poroshenko was examined.<\/em><\/p>\n<p><em>Petro Poroshenko&#8217;s lawyer Ihor Golovan noted after the Supreme Court session, which was postponed due to President Zelensky&#8217;s absence, that <a href=\"https:\/\/prm.ua\/advokat-holovan-ukaz-pro-nezakonni-sanktsii-proty-poroshenka-zlipyly-za-kilka-hodyn-i-vzhe-rik-zatiahuiut-sudovyy-protses-bo-nichoho-pokazaty\/\">this is not the first time the authorities have resorted to delaying the process<\/a>. &#8220;I really hope that all these tricks will eventually be exhausted, and the session on January 30 will take place,&#8221; the lawyer emphasized.<\/em><\/p>\n<p><em>Meanwhile, the European Solidarity faction called on President Volodymyr Zelenskyy <a href=\"https:\/\/prm.ua\/dumayte-pro-zakhyst-derzhavy-a-ne-pro-vybory-yevrosolidarnist-zaklykaie-zelenskoho-skasuvaty-nezakonni-sanktsii-proty-poroshenka\/\">to lift illegal sanctions against Petro Poroshenko<\/a> and stop using state instruments for electoral purposes.
