The Constitutional Court of Ukraine declared unconstitutional the norm that allowed the continuation of Roman Chervinsky’s arrest without a court decision under martial law.<\/strong><\/p>\n

This<\/span> was reported<\/span><\/a> by the press service of the Constitutional Court of Ukraine.<\/span><\/p>\n

As noted, Article 615 of the Criminal Procedure Code defines a special regime for criminal proceedings under martial law.<\/span><\/p>\n

In particular, Part 5 states: if it is impossible to hold a court hearing, the preventive measure in the form of detention selected by the investigating judge or the head of the prosecutor’s office during the pre-trial investigation is considered to be extended until the relevant issue is resolved, but not for more than two months.<\/span><\/p>\n

“In the opinion of the author of the petition, the contested provision of the Code, in particular, leads to the loss of effective judicial control and the possibility of imprisoning a person without investigating the validity of the accusation and the risks provided for by the Code, and allows for unmotivated judicial decisions,” the report says.<\/span><\/p>\n

Ultimately, the court, having examined the issues raised in the constitutional complaint, concluded that Part 5 of Article 615 of the CPC does not comply with the Constitution of Ukraine.<\/span><\/p>\n

\u201cThe Court ruled that the provision of the Code, recognized as unconstitutional, shall cease to be valid three months from the date of adoption of this Decision. In addition, the Court emphasized the need for the Verkhovna Rada of Ukraine to bring the regulatory regulation established by Part Five of Article 615 of the Code, recognized as unconstitutional, into line with the Constitution of Ukraine and this Decision,\u201d the press service added.<\/span><\/p>\n

Earlier, Petro Poroshenko paid bail for intelligence officer Roman Chervinsky<\/a> in the amount of 9 million hryvnias.<\/p>\n
