The current status of critical businesses and the reservation of their employees will remain in effect until September 1, 2026. At the same time, businesses must confirm compliance with the updated criteria after their review by government agencies.<\/strong><\/p>\n

<\/p>\n

The Cabinet of Ministers announced this, explaining changes to the booking procedure and determination of the criticality of enterprises, approved by a resolution dated May 30.<\/p>\n

<\/p>\n

The updated rules apply to enterprises, institutions, and organizations that are considered critical to the economy and functioning of the state under martial law.<\/p>\n

<\/p>\n

Among the key innovations is the introduction of a salary criterion. To confirm a company’s criticality and secure an employee’s employment, the average accrued salary must be at least three minimum wages, or UAH 25,941. For companies in frontline areas, the lower threshold of UAH 21,618 remains.<\/p>\n

<\/p>\n

The procedure for accounting for employees working part-time or with other deferments has also been changed. Now, such an employee can only be included in the reservation quota once per job.<\/p>\n

<\/p>\n

Furthermore, ministries, central executive bodies, and regional military administrations must review and approve criticality criteria in consultation with the Ministry of Defense and the Ministry of Economy. Following this, enterprises will be required to reconfirm their status.<\/p>\n

<\/p>\n

The government notes that until the end of the transition period \u2013 September 1 \u2013 both the current decisions regarding the criticality of enterprises and the already completed employee reservations will remain in effect.<\/p>\n

<\/p>\n

The Cabinet of Ministers also noted that the law does not provide for the possibility of reserving the employment of individual entrepreneurs, and the new salary criteria do not apply to state-owned and municipal enterprises. Decisions to confirm the criticality of the situation must be made within 10 business days of the submission of a complete set of documents.<\/p>\n
