Illegal sanctions will be lifted: Poroshenko’s lawyers go to the Grand Chamber of the Supreme Court, the ECHR, and the UN Human Rights Committee

The decision of the panel of judges of the Administrative Court of Cassation within the Supreme Court in the case of Petro Poroshenko’s lawsuit regarding sanctions was made under pressure.

This was reported by the European Solidarity website, citing a statement from the lawyers of the fifth President.

According to the lawyers, they are already appealing the decision in the Grand Chamber of the Supreme Court, and have also appealed to the European Court of Human Rights and the UN Human Rights Committee.

As noted, two judges – presiding judge Natalia Radyshevska and former chairman of the Cassation Administrative Court Mykhailo Smokovich – stated in their separate opinions that the authorities did not provide proper grounds for imposing sanctions against Petro Poroshenko. In their opinion, the sanctions should be canceled. At the same time, three other judges – Volodymyr Kashpor, Natalia Macedonska and Iryna Melnyk-Tomenko – supported the authorities’ position.

The lawyers also drew attention to the fact that the motivational part of the Supreme Court’s decision is partially classified. According to them, it does not contain information that has not been made public before. In particular, the sanctions were imposed on the basis of a letter signed by the head of the State Financial Monitoring Service, Philip Pronin, and the plot of the accusations against Petro Poroshenko, as the lawyers claim, repeats the publication of a publication associated with Andriy Portnov.

“You see an article in the publication “Law and Business”. The style is very easy to recognize – it was written by Andriy Portnov. He predicted that the National Security and Defense Council would impose sanctions against Poroshenko precisely for what Pronin proposed to impose them for a month later,” said lawyer Ilya Novikov.

He also noted that some of the NSDC members who voted for the imposition of sanctions have now been dismissed from their positions, are under investigation, or are involved in corruption scandals.

In turn, lawyer Ihor Golovan called the accusations of Petro Poroshenko’s alleged involvement in the preparation of the Kharkiv agreements absurd. He emphasized that at the time of their conclusion, Poroshenko did not hold a public position, and the agreements themselves, according to him, still have the status of valid on the website of the Verkhovna Rada.

The lawyers insist that the case before the Grand Chamber of the Supreme Court should be heard in public. They also expressed hope that Ukrainian courts would provide a legal assessment of the sanctions decree, and if necessary, international judicial institutions would make a final decision.

We will remind that the chairwoman of the Supreme Court’s panel of judges in the Administrative Court of Cassation, Olesya Radyshevska, believes that the sanctions against Poroshenko are illegal and should be canceled . She set out her arguments in a separate opinion to the court’s decision, which rejected the fifth President’s lawsuit by three votes.
