Students’ employment is not a reason for canceling the deferral from mobilization. The main condition for maintaining the right to deferral is full-time study and adherence to the principle of sequence of education.

This was reported by lawyer Maksym Gornostay in a comment for the portal ” Yuristy.UA “.

The lawyer emphasized that students who work while studying do not lose the right to a deferment from mobilization if they conscientiously attend classes and follow the curriculum at the educational institution.

According to the lawyer, the deferral is granted to full-time students, and the fact of official employment does not affect its validity. At the same time, there is an important nuance: the student must actually attend classes and take academic tests and exams according to the schedule.

“Employment of full-time students does not deprive them of the right to a deferral from mobilization. The only requirement is compliance with the curriculum,” Gornostay noted.

The lawyer also noted that attendance checks may be conducted for students of draft age. If it turns out that a student systematically misses classes and is not actually studying, he may be expelled from the university. In this case, the territorial recruitment centers (TCK) will have grounds to cancel the deferral and further mobilization.

“But as long as you attend an educational institution and follow the curriculum – you are considered a student, your deferral will be valid,” emphasized Gornostay.

It was previously reported that general mobilization is underway in Ukraine due to the full-scale invasion of the Russian Federation. Despite this, the issue of the possibility of a deferment for individual entrepreneurs (IEPs) remains relevant for many. Lawyers explained in which cases entrepreneurs can avoid conscription.

As you know, martial law and general mobilization have been extended in Ukraine. This means that men from 25 to 60 years old can be drafted into the army. At the same time, the law provides for exceptions – there are categories that receive a deferral or are not subject to mobilization at all .
