Naftogaz finally wins $1.4 billion lawsuit against Gazprom

The Federal Supreme Court of Switzerland has finally rejected the application of the Russian company Gazprom to annul the arbitration award in favor of NJSC Naftogaz of Ukraine. Thus, the Russian side must pay the Ukrainian company more than $1.4 billion in debt for services for organizing the transportation of natural gas and interest.
This was reported by the press service of Naftogaz.
The company noted that the court also ordered Gazprom to compensate for legal costs. These are 200,000 Swiss francs in legal costs, as well as 250,000 Swiss francs in costs that Naftogaz incurred during the proceedings at the Federal Supreme Court of Switzerland.
In July 2025, Gazprom initiated proceedings to annul the arbitration award and filed a motion to suspend its execution pending the conclusion of the case. In November 2025, the court rejected the motion to suspend the execution of the award, and has now completely rejected the Russian company’s complaint on the merits.
“Thus, the highest court of Switzerland confirmed the validity of the arbitration award and finally rejected the arguments of the Russian side. Naftogaz will continue to work on the enforcement of this award and continues a number of other processes against the aggressor country,” said Serhiy Koretsky, Chairman of the Board of Naftogaz of Ukraine.
As noted, the dispute arose within the framework of the Agreement on the Organization of Natural Gas Transportation, concluded in 2019. In accordance with this agreement, Naftogaz organized the transit of natural gas through the territory of Ukraine for Gazprom until its expiration on January 1, 2025.
In May 2022, the organization of gas transit through the Sokhranivka entry point became impossible due to the actions of the Russian occupation forces. Despite this, Naftogaz continued to provide transit services through the Sudzha entry point as stipulated in the agreement.
At the same time, Gazprom refused to pay the full amount of the fee for organizing gas transportation, thereby violating its contractual obligations. In September 2022, Naftogaz initiated arbitration proceedings in Switzerland in accordance with the rules of the International Chamber of Commerce.
In June 2025, the arbitration court found Gazprom liable for failure to fulfill payment obligations and ordered it to pay the debt, interest, and arbitration costs.
