New rules for deferring mobilization have been introduced in Ukraine: resolution

The Cabinet of Ministers has approved new rules for reserving military conscripts. The main innovation: if an enterprise loses its critical status, all its reserved employees automatically lose their deferral, even if they were issued earlier.

The changes were announced by People’s Deputy Yaroslav Fedienko, Telegraf reports.

The main thing:

in some cases, the reservation is canceled instantly;

The right to make reservations was granted to employees of the Red Cross and Ukrainian humanitarian NGOs;

Managers are required to make or cancel a reservation through “Diya” within 5 business days;

Enterprises will be held liable for violating limits.

The Red Cross and humanitarian organizations can now book staff

The government has expanded the list of organizations whose employees can receive deferrals. The following have been added to the list:

Ukrainian Red Cross Society,

Ukrainian non-governmental organizations that implement humanitarian projects with international funds.

A separate procedure applies to these structures: the reservation is automatically terminated if:

the humanitarian project has been completed,

the contract has been terminated,

The organization was removed from the special list.

Previously, humanitarian organizations did not have the ability to book workers at all.

The interdepartmental working group gained real control over the limits

The new rules significantly strengthen the powers of the Interagency Working Group, established in 2024.

Now:

The Ministry of Defense cannot increase the limits by more than 50% without the recommendations of this group;

all decisions on the right to reserve are made on the basis of her proposals;

information is entered into the Unified List through “Diya” (EDRPOU, name, number of conscripts, limit, validity period – up to a year).

Five days to process – otherwise the reservation will be lost

The resolution introduces strict time frames:

5 days for processing

After changing the limit in “Diya”, the company’s management has 5 working days to make a reservation. If it is not made, the decision of the Ministry of Defense becomes invalid.

5 days to cancel

When the deferral expires, the manager also has 5 business days to cancel it.

For certain categories of military conscripts, transfer to special registration occurs automatically within 24 hours.

Businesses are responsible for each booked employee

The state is strengthening control over limits:

the number of reserved persons cannot be greater than the number of conscripts determined in the decision on critical importance;

enterprises must monitor compliance with limits;

The criticality decision now contains clear data on all military-enlisted employees and those who may be booked.

In this way, the government is trying to eliminate abuse and make reservations more transparent and controllable.

As a reminder, updated rules for reserving employees of critical enterprises will come into effect in Ukraine on December 4. The document allows for the temporary reservation of persons with violations in their military registration documents for a period of up to 45 calendar days.

As reported, President of Ukraine Volodymyr Zelenskyy signed a law that allows defense-industrial complex enterprises to reserve men with the status of “wanted” or “not on the register.” The document defines the procedure for booking such workers and establishes restrictions on the terms of validity of this decision.
