The Verkhovna Rada of Ukraine adopted bill No. 13155, which provides for exemption of owners of destroyed or damaged housing from payment of a portion of housing and communal services.
308 members of parliament voted in favor of the document. Its adoption was announced by parliamentarians Yaroslav Zheleznyak and Sofia Fedina .
The law is intended to regulate the situation where building managers, housing cooperatives, or homeowners’ associations (HOAs) continued to charge rent even for housing that was destroyed or unfit for habitation.
Now, owners will be exempt from paying for apartment building management services if the property is damaged or destroyed and not actually in use. This applies to individual apartments, non-residential premises, and common areas.
Special commissions will determine the extent of damage or destruction after an inspection. They will establish the date of damage and restoration, which will serve as the basis for:
- suspension or resumption of utility bills;
- recalculation or adjustment of the cost of housing services;
- complete cancellation of charges for destroyed property that cannot be restored;
- suspension of payment of property tax (except for land).
The new rules are expected to remain in effect during martial law and for one year after it ends.
