Petro Poroshenko’s lawyers have already filed an appeal against the Supreme Court’s decision to refuse to lift the illegal sanctions imposed by Zelensky.
This was reported by lawyer Ilya Novikov on Channel 5.
“We have already filed an appeal, we did not wait for the full text of the decision. We are convinced that no matter what we read there, it will not distract us from our belief that the decree is indeed illegal. And the corresponding decision to refuse to satisfy the claim is also illegally based,” he said.
Novikov added that the ECHR has already accepted one segment of this case for consideration.
“The ECHR has taken up for consideration the question of whether a situation where a sanctions decree cannot be temporarily suspended by a court is legal and consistent with the European Convention on Human Rights,” the lawyer said.
According to him, there is a provision in the Code of Administrative Procedure that states that the court cannot temporarily suspend the president’s decrees, there is no such preventive measure, and there is also no exception for the decree on sanctions.
“In most countries that use this sanctions mechanism, there are certain exceptions. If we are talking about a person who is currently in the territory of this country, usually he is not a citizen of this country, because the absolute majority, including European countries, do not apply sanctions against their citizens. But if it so happens that a person is physically in the country, then either the court decides this, or the bodies that apply sanctions decide it, certain expenses are necessarily provided for – payment of lawyers, for example, household expenses. Every time Poroshenko refuels his motorcycle, he violates the law,” Novikov explained.
The lawyer emphasized that “Zelenskyy forbade him from all business contracts without exception.”
“Buying gasoline, buying food is also a contract, it is also a transaction. It is illegal,” he concluded.
As is known, the Supreme Court, under pressure from the authorities, refused to lift illegal sanctions against opposition leader Petro Poroshenko – this decision will block Ukraine’s membership in the EU.
