Public Anti-Corruption Council of the Ministry of Defense on Defence City: we insist on the need to finalize the draft laws
The corresponding official statement was published on Facebook of the Public Anti-Corruption Council under the Ministry of Defense of Ukraine.
“Defense City, as it is declared, is a program aimed at introducing a special regime to support Ukrainian defense manufacturers. It consists of four major draft laws that provide for amendments to the Tax (No. 13420), Customs (No. 13421), Budget (No. 13422), Criminal and Criminal Procedure Codes (No. 13423).” – the Public Anti-Corruption Council reports.
According to the GAR of the Ministry of Defense, the changes to the legislation have many “buts”:
– in its current version, the document contains norms that actually provide for complete exemption from criminal liability of persons who committed offenses during the execution of a defense order – even if these violations have been proven.
– the model looks like it will operate in manual mode with limited access. This creates risks of repeating the practice of the “club of the chosen ones”;
– a separate provision of the draft law stipulates that enterprises that are residents of Diya.City cannot become participants in Defence City. This creates unjustified barriers for those who have already proven their effectiveness in producing technological solutions for the front;
– the income tax benefit is provided in such a way that it does not reduce, but, on the contrary, increases the complexity for the payer – both in reporting and in the risks of tax pressure;

“The draft law on amendments to the Criminal and Criminal Procedure Codes of Ukraine cannot be put to a vote at all,” the GAR of the Ministry of Defense emphasizes.
The Public Anti-Corruption Council appeals to industry and the public: “read the content of the draft laws and provide your suggestions. The success of Defence City depends entirely on how well the rules are written and how transparently the system will operate.”
We will remind, earlier the head of the GAR MOU – veteran and public figure Yuriy Hudymenko spoke about the amendments to the Criminal Code within the framework of Defence City : “The bill, #13423 is complete hell, with which nothing can be done except to throw it in the trash along with the authors.”
