Russia ignores ECHR demands in cases of deported children and MH17

Russia refuses to comply with the decision of the European Court of Human Rights in the case “Ukraine and the Netherlands v. Russia.” On July 9, 2025, the court found the Russian Federation responsible for systemic human rights violations, the illegal transfer of Ukrainian children, and the downing of flight MH17.
This is stated in the summary of the meeting of the Committee of Ministers of the Council of Europe, dedicated to monitoring the implementation of this ECHR ruling.
The Committee of Ministers of the Council of Europe stressed that even after its expulsion from the organization, Moscow remains obliged to abide by the European Convention on Human Rights and implement the decisions of the ECHR. At the same time, Russia has completely stopped communicating with the Committee and has not provided any action plan to implement the ruling.
The court considered four interstate complaints from Ukraine and the Netherlands at once: regarding the deportation of children, crimes committed by the Russian army since 2014, the shooting down of the MH17 plane, and mass violations after February 24, 2022. The ECHR obliged Moscow to release illegally detained Ukrainians, provide a complete list of deported children, and facilitate the creation of a mechanism for their return.
Russia ignored all demands. The Committee of Ministers condemned the systematic abduction of Ukrainian children, their adoption in the Russian Federation, and the imposition of Russian citizenship. It called on the Kremlin to immediately end these practices and provide data on the children’s whereabouts.
A separate part of the resolution concerns the downing of flight MH17. The committee stated that Russia is blocking the investigation and hiding information, so member states demand a public apology and recognition of responsibility for the deaths of 298 people.
The Committee also condemned Russia’s massive war crimes in the occupied territories of Ukraine – torture, rape, attacks on civilians and infrastructure, blocking evacuation and humanitarian aid. The Council of Europe countries called on the Kremlin to stop attacks on civilians and cooperate with international investigators.
As previously reported, the Second Pre-Trial Chamber of the International Criminal Court issued arrest warrants for former Russian Defense Minister Sergei Shoigu and Chief of the Russian General Staff Valery Gerasimov.
As a reminder, on March 17, 2023, the International Criminal Court issued an arrest warrant for Russian President Vladimir Putin and Commissioner for Children’s Rights Maria Lvova-Belova in connection with the Russian Federation’s actions regarding the deportation of Ukrainian children.
