SAP and NABU complete investigation into Kolomoisky case

NABU and the Specialized Anti-Corruption Prosecutor’s Office have completed the investigation into the case of former PrivatBank owner Igor Kolomoisky, who is suspected of attempting to seize UAH 9.2 billion.

The case was also closed against five former top managers of PrivatBank, who, according to the investigation, took part in the scheme. NABU detectives began to transfer the case materials to the defense for review.

According to investigators, in January-March 2015, one of the managers of PrivatBank developed a scheme to seize the bank’s funds. The goal was to finance his own offshore company and increase his stake in the bank.

The chairman of the board, his deputies and heads of departments were involved in the scheme. Due to forged documents, the bank allegedly has to pay more than UAH 9.2 billion for the redemption of bonds at an inflated price.

More than UAH 446 million of these funds were laundered through securities agreements and transferred to the personal account of the bank owner. Subsequently, this money was returned to the bank to formally fulfill the conditions of financial recovery. The rest of the money was used at its own discretion.

All participants are suspected under the following articles of the Criminal Code:
Art. 191 – misappropriation or embezzlement of property;
Art. 209 – legalization of proceeds from crime;
Art. 366 – official forgery.

The case will then go to court after reviewing the materials.

Let us recall that on July 22, the Verkhovna Rada voted for a bill that significantly limits the powers of the National Anti-Corruption Bureau (NABU) and the Specialized Anti-Corruption Prosecutor’s Office (SAPO) , effectively subordinating their activities to the Prosecutor General.

Subsequently, the heads of the National Anti-Corruption Bureau and the Specialized Anti-Corruption Prosecutor’s Office appealed to President Volodymyr Zelenskyy not to sign the bill , which, in their opinion, destroys the independence of these bodies.

However, President Volodymyr Zelensky signed a controversial law that significantly changes the powers of the National Anti-Corruption Bureau (NABU) and the Specialized Anti-Corruption Prosecutor’s Office (SAPO), strengthening control by the Prosecutor General.

As reported, the National Anti-Corruption Bureau of Ukraine and the Specialized Anti-Corruption Prosecutor’s Office have released an official statement regarding draft law No. 12414, which is being prepared for the second reading in the Verkhovna Rada. The anti-corruption agencies warn that the latest amendments to the document pose a serious threat to the independence of their activities.

In addition, mass protests against draft law No. 12414, which, according to activists, threatens the independence of the anti-corruption institutions NABU and SAP, took place in Kyiv, Lviv, Dnipro, Odessa, Lutsk and Ivano-Frankivsk. The protesters demand that the president immediately veto the document, which could significantly change the balance of the anti-corruption system of Ukraine.

By the way, the Verkhovna Rada plans to prepare a submission to the Constitutional Court of Ukraine with the aim of repealing Law No. 12414, which limits the independence of the National Anti-Corruption Bureau (NABU) and the Specialized Anti-Corruption Prosecutor’s Office (SAPO).
