“Servants” propose to punish soldiers for disobeying the commander’s order with imprisonment: what is known

Military serviceman Serhiy Gnezdilov reported that Serhiy Ionushas, a deputy from the “Servant of the People” party, is proposing a bill that provides for a prison sentence of 5 to 10 years for disobeying a commander’s order.

Military personnel and experts express doubt about the feasibility of this initiative, emphasizing that the Ukrainian army and legal system have different principles of motivation and discipline, and increasing the terms will not solve the problem of unauthorized leaving the unit and desertion.

The bill, authored by Serhiy Ionushas, provides for severe punishment for servicemen for disobeying a commander’s order: from 5 to 10 years in prison. At the same time, the bill prohibits courts from mitigating punishment.

Gnezdilov criticized the initiative, as none of the three co-authors of the bill served in the Ukrainian army.

The military stressed that increasing the terms “does not scare those who need to be scared,” but instead can only destabilize the system of law and duty in the military.

He emphasizes that Ionushas’ previous attempts to “increase the terms for desertion/desertion” did not solve the problem: during the full-scale invasion of Ukraine, more than 300,000 cases of unauthorized abandonment of units were recorded, and the law on “first time not counted” continues to operate.

Gnezdilov emphasized that such harsh punishments might work in Russia, with its centuries-old penal system and large number of prisons, but they are not effective for the Ukrainian army and legal system.

Instead, it is proposed to concentrate legislative efforts on combating the aggressor and strengthening discipline through motivational and organizational methods.

The military called on the deputies to stop such “legislation” if it is not based on real experience and does not take into account the specifics of the Ukrainian army.

“Better yet, give Russia a hard time, as several of your party colleagues did at the beginning of the war, for which I am sincerely grateful,” Gnezdilov concluded.

It was previously reported that the Cabinet of Ministers of Ukraine is initiating amendments to the Criminal Code, whichpropose establishing criminal liability for violation of the established terms of stay outside the country by military conscripts.
