The Cabinet of Ministers has introduced a special procedure for the export of military and dual-use goods for the period of martial law. It opens up the possibility for Ukrainian defense manufacturers to export their products, but only within the framework of a state-controlled mechanism.

This is reported by the publication “Oboronka”.

The new procedure does not abolish the current system of state export control, but supplements it. The general rules established by Resolutions No. 1807 and No. 86 remain in force, unless they contradict the new norms.

Exports will be subject to two key lists: critical goods and technologies, and countries to which international transfers are permitted. Both lists are to be reviewed quarterly.

To obtain a permit, exporters must provide documents confirming the foreign counterparty’s compliance with the requirements of the Procedure and state guarantees of the importing country. In addition, enterprises must adhere to compliance requirements throughout the entire cycle of the export transaction.

At the same time, experts draw attention to possible risks for business. In particular, the amendments to Resolution No. 746 provide for a fee for issuing permits: 20% of the cost of exporting finished products, 30% for components, and 20% for exporting technologies and re-exporting products. According to the authors of the material, such rates can become a significant financial barrier for manufacturers.

The publication notes that the effectiveness of the new mechanism will depend on the launch of the electronic system, the operation of the tacit consent mechanism, regular updating of lists, and simplification of procedures for related operations, including repairs and service.

If these conditions are met, Ukraine can obtain a full-fledged mechanism for exporting defense products. Otherwise, the new order risks remaining a formal instrument with overly complex conditions for business.

It was previously reported that the German federal government approved the draft state budget for 2027 , which provides for the allocation of 11.6 billion euros for military assistance to Ukraine, as well as a significant increase in the country’s defense spending.
