The Notary Chamber demands to stop testing of e-notary services due to data leak

A scandal has erupted in Ukraine over the testing of an e-notary system. The Notary Chamber announced a data leak from state registers in the training version of the program, which is a gross violation of the law. The organization appealed to the government to immediately stop the experiment and protect notarial secrecy.
The letter sent to ministers Mykhailo Fedorov and Herman Galushchenko pointed to an “unprecedented case of violation of notarial secrecy” when the test version contained real powers of attorney and wills.
“All powers of attorney, all wills that were entered into the specified registers by a certain date became available to all testers (notaries who did not perform these notarial actions, employees of territorial bodies involved in testing the system or involved in organizing testing, a wide range of persons, including developers, donors, organizers, and technical staff),” the document states.
The Chamber emphasized that the disclosure of data contradicts Article 1255 of the Civil Code on the secrecy of wills, Article 8 of the Law “On Notaries”, and the provisions on the Inheritance Register.
The testing of the system lasts from September 3 to 30, but the NPU emphasized that the allotted 27 days are not enough for a quality test. In addition, participants complain about the lack of instructions and other organizational problems.
“The NPU, as a professional self-governing organization that represents and protects the interests of not only notaries, but also individuals and legal entities, cannot remain aloof from these facts and requests that the testing of the e-notary system be stopped to verify the information provided,” the statement says.
At the same time, the Chamber confirmed its readiness to cooperate with state authorities to resolve the situation and refine the system.
It was previously reported that the Kyiv City Prosecutor’s Office has declared a private notary public suspect who facilitated the raider seizure of a shopping center in Kyiv with an area of over 4,000 sq m and a value of 120 million hryvnias.
