“They will disperse”: the government could not explain why they are not allowing deputies to go abroad

The Court of Appeal has put an end to the scandalous case of banning deputies from traveling abroad. The government decree that restricted the movement of people’s representatives was declared illegal after almost two years of legal proceedings.

The Sixth Administrative Court of Appeal has declared illegal the Cabinet of Ministers’ resolution that previously regulated the travel of deputies and other officials outside the country without the permission of the leadership. This decision, which concerns a court appeal by the fifth president, confirmed that the government’s actions against him were unlawful, and the government’s restrictions were politically motivated and contrary to current legislation.
In addition, it is noted that this decision takes on particular importance in the context of European integration aspirations, as the European Parliament has previously emphasized the need to resolve such problems to improve the country’s reputation.
It should be noted that during the court hearing, a representative of the Cabinet of Ministers stated that it is impossible to let deputies go abroad so that they do not “run away”. According to him, the purpose of this resolution is to prevent the departure of people’s deputies and ensure the country’s defense capability. However, for almost a year, people’s deputies were free to travel, and the parliament continued to function without obstacles.
At the same time, the court, having considered the case, effectively supported the position that the ban on leaving without a management permit created unlawful obstacles to the performance of duties. This government decree, which introduced the so-called “travel ban”, has now been declared invalid, which paves the way for a review of border crossing procedures for a wide range of state figures.
