President Zelensky’s representative in the Supreme Court acknowledged that changes were made to the signed Decree on Enforcing the NSDC Decision on Sanctions against Poroshenko, which she called “technical amendments.”

As is known, Petro Poroshenko is contesting the introduction of illegal sanctions. The fifth president believes that the documents on the introduction of sanctions were falsified. For 7 months, government officials have been unable to provide the full volume of relevant materials at the request of the panel of judges.

As reported by lawyer Ihor Holovan, on July 31, the decision of the Vinnytsia District Administrative Court on Petro Poroshenko’s lawsuit against the NSDC apparatus and the NSDC secretary entered into force.

“In particular, it was established that the materials of the Decree with the appendix, which was sent for the president’s signature and dated February 12, 2025, contained errors, in particular, Petro Poroshenko’s identification code indicated 11 digits instead of 10. Accordingly, the court established the fact that the president put the Presidential Decree into effect by mistake,” Golovan said.

The court also found that the National Security and Defense Council requested the return of the appendix with an error in the letter and sent a different text on the 13th – the day after the Decree was signed. Thus, the text of the Decree was illegally changed.

The court also noted that the current legislation of Ukraine does not provide for the possibility of correcting errors or making amendments to regulatory legal acts, including decisions of the National Security and Defense Council of Ukraine and Presidential Decrees outside the established procedure for adopting the relevant act.

“These conclusions, which were made by the court, were not disputed by the apparatus of the National Security and Defense Council, were not disputed by the Secretary of the NSDC, the court’s decision entered into force,” said Golovan.

During a meeting of the panel of judges, the fifth President stated that the authorities have not been able to hand over all documents at the court’s request for 7 months.

“I have a well-founded suspicion of falsification of the materials that were transferred to the Cabinet of Ministers and the National Security and Defense Council. Transfer to the seventh month of the process the original materials on the basis of which you were either deliberately manipulated, or you misled those who prepared and signed the decision on sanctions,” Poroshenko addressed to representatives of the authorities.

It is worth recalling that on July 23, the panel of judges of the Cassation Chamber of the Supreme Court decided to request from the National Security and Defense Council, the Cabinet of Ministers, and the Ministry of Economy all documents related to the process of adopting the decision on sanctions. The deadline for submitting documents expired on August 11.

“The first meeting was on April 17, and only one meeting was held each month. All this time, it was a preparatory stage, we were finding out what other documents the government had not provided, and why it had not provided them, and whether it could provide them. In the end, we still began to discuss the merits of this case. We presented our arguments to the court, we heard the position of the president’s representative, which boils down to the fact that the president can do anything,” lawyer Ilya Novikov told reporters in a comment.

Earlier, during a meeting of the panel of judges of the Cassation Chamber of the Supreme Court in the case of a lawsuit against President Volodymyr Zelensky regarding the illegal Decree on sanctions, Petro Poroshenko stated that the authorities have not been able to hand over all documents at the court’s request for 7 months.
