Lawyer Ilya Novikov expressed doubts about the legality of the sanctions that the National Security and Defense Council plans to impose on the person involved in the NABU case, because such “restrictions” are a political project of President Volodymyr Zelenskyy, aimed at saving his own image and distancing himself from the scandal.
On the air of “Pryamoy”, Novikov suggested that the urgent initiative of the Cabinet of Ministers, approved by President Zelensky, may contain numerous procedural violations, which jeopardizes the legitimacy of the entire process.
Novikov drew a parallel with the sanctions against Petro Poroshenko imposed in February, which are currently being appealed in the Supreme Court. “It turned out that this is simply impossible. That is, they cut so many corners that cannot be cut, bypassed so many procedures, made so many approvals incorrectly, that we can immediately say that these sanctions against Poroshenko since February are illegal,” the lawyer said.
According to him, the initiation of sanctions against individuals is mainly handled by the Security Service of Ukraine, not the Cabinet of Ministers. The government takes such a step mainly to synchronize with the restrictive measures of international partners, which does not correspond to the current situation. This is the second time that the government has urgently submitted such a decision.
Given the experience of previous decisions, there is a high probability that the sanctions against Mr. Mindych, implemented in such an urgent manner, will be declared illegal due to a violation of the established procedure. The lawyer emphasized that he had not yet seen the documents, but previous experience provides grounds for such conclusions.
In addition, according to Novikov, the introduction of sanctions against the person involved in the NABU case is a political project of President Zelenskyy, aimed at saving his own image and distancing himself from the scandal. At the same time, the lawyer drew attention to the fact that the authorities’ reaction to the scandal was belated. Only on the third day after the information about the searches appeared, when it became clear that society would not accept silence, did an initiative regarding sanctions appear, which he called a “special operation.”
We will remind that on November 10, detectives of the National Anti-Corruption Bureau conducted searches at the home of businessman and co-owner of the Kvartal 95 studio, Timur Mindich, who is an associate of President Volodymyr Zelensky. However, the person involved in the case left the territory of Ukraine a few hours before the searches .
It was previously reported that NABU and SAPO are conducting a large-scale operation “Midas” to expose corruption in the energy sector. According to the investigation, the activities of a high-level criminal organization were established, which controlled financial flows and personnel decisions in state energy structures. In particular, law enforcement officers conducted searches at the home of former Energy Minister German Galushchenko and at JSC “NAEK “Energoatom” .
Later it became known that the Cabinet of Ministers of Ukraine decided to remove Herman Galushchenko from the duties of the Minister of Justice. Also, the journalists of “Schemes” established the names of the persons to whom NABU detectives informed about the suspicion within the framework of the investigation of corruption in the energy sector.
Meanwhile, President of Ukraine Volodymyr Zelenskyy announced that he would sign a decree imposing sanctions against participants in the corruption scheme at Energoatom. In addition, the Cabinet of Ministers decided to immediately suspend Vice President and Board Member of Energoatom Jakob Hartmut.
