On October 23, the Cabinet of Ministers adopted Resolution No. 1328, which changes the procedure for reserving military personnel. Now, decisions on the status of critical enterprises will be made through the Coordination Center, and the current criteria will be revised.

According to analysts, the final text of the document is almost the same as the previous draft. Among the changes is the inclusion in the list of humanitarian organizations without which the state will not be able to work during a special period.

One of the main innovations concerns obtaining the status of a critical enterprise. Now, this requires a recommendation from the Coordination Center. The relevant body will have up to seven working days to consider the application, the Center – up to one month, and the final decision must be made within three working days. In total, the procedure can last up to a month and a half.

In addition, within 10 days, state authorities must review the industry-specific criticality criteria and agree them with the Center. If the criterion by which the enterprise received the status is canceled, the company may lose it. Other current decisions will remain valid until the end of the established period.

The procedure for reserving more than 50% of employees is also changing. Such decisions will be valid for no more than a year and will be approved by the body that granted the enterprise critical status.

After receiving the permit, the company will have 10 business days to make a reservation through “Diya”. If this is not done, the decision will become invalid. After the reservation period expires, the deferrals will be canceled within five business days.

The government has set higher limits for certain industries. Defense and energy companies, their contractors, and transformer manufacturers will be able to reserve up to 95% of their employees. Exceeding this figure will require a decision from the Ministry of Defense or the Ministry of Energy.

At the same time, for projects funded by international donors, restrictions have been set – no more than half of the team and a maximum of seven employees. Increasing the limit will require a separate decision by the State Secretary of the Cabinet of Ministers.

The Coordination Center will also be able to refuse to increase the reservation limit if the head of the enterprise has violated the military registration rules twice during the year.

The new rules define 13 industries whose companies can receive the status of critical in a general manner. These include the defense industry, energy, IT, banking, healthcare, and communications. Other areas will require separate approval from the Center.

At the same time, regional administrations will be able to designate enterprises as critical only in certain sectors. Companies in the defense industry, IT, banking, healthcare, and communications sectors must contact the relevant central authorities.

A separate relaxation has been provided for government contractors. If the tax debt arose due to a delay in budget payments, it will not become an obstacle to obtaining the status of a critical enterprise until the funds arrive.

In addition, the government has redistributed powers between state bodies. The interdepartmental working group and the Ministry of Defense will no longer make decisions on reservations under the previous mechanism. Some of the functions of the state enterprise “State Operator of Logistics” will be transferred to the state enterprise “Ukrainian Center “Bezpeka”.

At the same time, previously adopted decisions by the Ministry of Defense to increase reservation limits will be valid until December 8, 2026 at the latest.

As a reminder, on October 23, the Cabinet of Ministers announced the creation of a Coordination Center for Organizing Reservations . At that time, it was also about revising the criteria for the criticality of enterprises and a quota of up to 95% for the defense and energy sectors.

Earlier, more than 60 MPs demanded a review of the government’s changes to the booking rules . The parliamentarians advocated for additional consultations with businesses on the proposed restrictions.
