Who can receive compensation for unused vacation: clarification from lawyers

In Ukraine, employees can receive monetary compensation for a portion of unused annual leave, provided that they comply with legal requirements. However, it is not permitted to completely waive mandatory annual leave for the sake of payment.
This was reported by the Federation of Trade Unions of Ukraine.
Lawyers recalled that the law guarantees employees the right to annual paid leave . An employee must use at least 24 calendar days of vacation during the year , so it is impossible to replace the entire vacation with monetary compensation.
Employees whose employment contract provides for vacation of more than 24 calendar days are entitled to compensation. After using the mandatory 24 days, they can receive monetary compensation for the remaining unused days .
As an example, the lawyers cited a case where an employee is entitled to 28 calendar days of vacation: 24 basic days and 4 additional days for irregular working hours. After using the mandatory 24 days, he can apply for compensation for 4 additional days.
There are separate rules for employees under the age of 18. The law prohibits replacing their annual leave with cash compensation, so they must use all their appropriate rest days.
Lawyers also noted that if an employee used vacation in advance and later quit, the employer has the right to withhold funds from the salary for vacation days that were not worked.
