The institution of sanctions applied to citizens of Ukraine is causing heated debate among lawyers due to possible contradictions with the norms of the Constitution. The practice of using lists to combat domestic offenses replaces the work of investigative bodies and courts.
This opinion was expressed on the air of “Pryamoy” by blogger and entrepreneur Karl Volokh.
“The institution of presidential sanctions is generally… it is such a mockery of the Constitution that it is even hard to imagine. These are extrajudicial executions,” the analyst emphasized, recalling cases of famous politicians and businessmen.
According to him, such an approach becomes an obstacle on the path to European integration, where the rule of law is a basic requirement.
Another guest on the air, candidate of political sciences Bohdan Ferens, adds that the first cluster of negotiations with the EU requires transparent legal procedures, where every citizen has a guaranteed right to protection. The lack of trust in the judicial branch of power only deepens the problem, turning legal processes into long marathons without a clear ending, the expert believes.
On the eve of the event, a journalist for Ukrainska Pravda, Mykhailo Tkach, stated that in Ukraine the sanctions mechanism is used not as an instrument of state policy, but as a method of political influence .
In addition, lawyer Ilya Novikov writes on his Facebook page that the authorities have finally turned the sanctions mechanism into an instrument of political revenge , and this is already obvious to everyone. At the same time, President Zelensky is hiding behind the collective responsibility of the NSDC, and sanctions are being imposed without any legal grounds.
